Terms of Service - SentiLog

Please read these Terms of Service ("Terms") carefully before using the SentiLog mobile application ("App") operated by the SentiLog developer ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

SentiLog is a personal journaling application that uses on-device artificial intelligence to detect emotions in your text entries. The App provides sentiment analysis, an emoji-based mood calendar, encrypted data storage, and optional cloud backup via Google Drive.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. User Content

Ownership: You retain full ownership of all journal entries, text, and content you create within the App ("User Content"). We do not claim any ownership rights over your User Content.

Responsibility: You are solely responsible for your User Content. We do not review, monitor, or access your journal entries at any time.

4. Privacy and Data Security

Your privacy is fundamental to our service. Please refer to our Privacy Policy for detailed information on how your data is handled. Key points:

• All data is stored on your device and encrypted using industry-standard AES-256 encryption.
• Sentiment analysis is performed entirely on your device. Your text is never transmitted to any external server.
• Cloud backup, if enabled, is encrypted before upload to your personal Google Drive account.
• We do not collect, access, or store any of your personal data or journal entries.

5. Subscriptions and Payments

Free Tier: The App is free to use with basic features including 3 emotion categories and the English sentiment model.

Premium Subscription: Premium features (28 emotions, multilingual AI models, additional themes, biometric lock, calendar history, cloud backup) are available through a paid subscription managed by Google Play.

• Payment is processed exclusively through Google Play. We do not collect or store payment information.
• Subscription terms, pricing, renewal, and cancellation are governed by Google Play's terms and policies.
• You may cancel your subscription at any time through Google Play. Access to Premium features will continue until the end of your current billing period.
• Refund requests must be directed to Google Play in accordance with their refund policy.

6. Intellectual Property

The App, including its design, code, AI models, graphics, user interface, and branding, is the intellectual property of the SentiLog developer and is protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the App.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code or AI models from the App.
• Circumvent, disable, or interfere with any security features of the App.
• Use the App to develop competing products or services.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The emotion detection or sentiment analysis will be accurate or reliable.
• Any defects in the App will be corrected.
• The App is free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the SentiLog developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, including journal entries, whether caused by device failure, App malfunction, encryption key loss, or any other reason.
• Inaccurate emotion detection or sentiment analysis results.
• Unauthorized access to your data due to factors beyond our reasonable control.
• Any decision made or action taken based on information provided by the App.

You acknowledge that you use the App at your own risk and are responsible for maintaining backups of your data.

11. Data Loss

While we implement robust encryption and data protection measures, we cannot guarantee against data loss. Circumstances that may result in data loss include:

• Device loss, damage, or factory reset.
• App uninstallation without prior cloud backup.
• Corruption of encryption keys.
• Failure of cloud backup or restore processes.

We strongly recommend enabling cloud backup and regularly verifying that your backups are current.

12. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms:

• Google Play: For app distribution, subscription management, and billing.
• Google Drive: For optional encrypted cloud backup (requires Google account sign-in).

We are not responsible for the availability, performance, or terms of these third-party services.

13. Updates and Changes

We may update the App from time to time to improve features, fix bugs, or address security issues. Continued use of the App after an update constitutes acceptance of any changes. We may also modify these Terms. Material changes will be communicated through the App or our website.

14. Termination

You may stop using the App and uninstall it at any time. Upon uninstallation, all locally stored data will be permanently deleted. Cloud backups on Google Drive will remain until you manually delete them.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the SentiLog developer regarding your use of the App and supersede all prior agreements and understandings.
